Divorce by mutual consent or agreement is a type of divorce that came with family codes in the Arab countries. Sections of divorce by mutual consent

Divorce by mutual consent established in accordance with the Family Code Law is divided into two types:

  • Divorce by mutual consent: This is the divorce that both parties resort to with their mutual consent without commenting on specific conditions.
  • Divorce by mutual consent and restriction: It is the one that is restricted by the spouses with one or more conditions that must not be inconsistent with public order and the provisions of the Family Code, and will not have any negative consequences for children and their rights.

Divorce procedures by mutual consent

  • File an introductory petition with the court in the personal status department.
  • The request of the two parties, through the petition, to break the marital bond through divorce with the consent of both parties.
  • Hold a session in the court to reconcile the dispute during the session, and if the reconciliation is not achieved, both spouses declare that they agree to divorce by mutual consent, and the court rules and documents the divorce.
