There is no specific and fixed formula for writing a will, but rather writing a will requires that a person express what he wants to bequeath. من ماله لشخص ما، فيمكنه أن يقول (أوصي لفلان بكذا من المال)، ويتطلب ذلك أيضاً ذكر مقداره، وذكرت الموسوعة الفقهية: “ذَهَبَ الْفُقَهَاءُ إِلَى أَنَّهُ يُسْتَحَبُّ لِلْمُسْلِمِ إِذَا أَوْصَى أَنْ يَكْتُبَ وَصِيَّتَهُ، لِقَوْلِهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: مَا حَقُّ امْرِئٍ مُسْلِمٍ لَهُ شَيْءٌ يُوصِي فِيهِ، يَبِيتُ ثَلاَثَ لَيَالٍ إِلاَّ وَوَصِيَّتُهُ مَكْتُوبَةٌ عِنْدَهُ ـ وَفِي لَفْظٍ: يَبِيتُ لَيْلَتَيْنِ ـ وَيُسْتَحَبُّ لِلْمُوصِي أَنْ يَبْدَأَهَا بِالْبَسْمَلَةِ وَالثَّنَاءِ عَلَى اللَّهِ تَعَالَى بِالْحَمْدِ وَنَحْوِهِ وَالصَّلاَةِ عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ثُمَّ الشَّهَادَتَيْنِ كِتَابَةً، أَوْ نُطْقًا، ثُمَّ الإِْشْهَادِ عَلَى الْوَصِيَّةِ، لأَِجْل صِحَّتِهَا and enforce it, and to prevent the possibility of its ingratitude and denial.”

The commandment begins with praise to God, and prayers upon the Messenger of God, may God’s prayers and peace be upon him, and after that the text of the will is as follows: (This is what so-and-so, son of so-and-so recommended, and he testifies that there is no god but God alone with no partner, and that Muhammad is His servant and His Messenger, and that Jesus is His servant. God and His Messenger, and that it is the word of God that He bestowed upon the Virgin Mary, and that Heaven is true, and Hell is true, and that the Hour is no doubt about it, and that God will resurrect those in the graves, and I advise my children, my family, my relatives, and all Muslims to fear God Almighty, and I advise them as Abraham enjoined upon his sons and Jacob :(And Abraham recommended it to his sons and Jacob, my son. God has chosen religion for you, so do not die unless you are Muslims.)).

He must also recommend that he pay off his debts, and specify if he wants to give a third of his money to so-and-so, or to ongoing charity, or to his minor children, with specifying their guardian. So that he preserves their rights until they grow up and reach maturity, and after that he recommends to his family the religious and social commandments, and that he recommends that he wash and bury him and what follows that according to the Sunnah of the Messenger Muhammad, may God bless him and grant him peace, and finally the will is concluded by praying for the soul with forgiveness, mercy, and entry to heaven, and he must document the commandment with testimony Two fair men.

The wisdom of writing the will

Wisdom stems from writing the will, reminding the Muslim of death in most of his times, which leads to the Muslim’s keenness to work hard in order to win Paradise, and that is through repentance from sins, reforming deeds, returning rights to their owners, and apologizing for mistakes committed with the rights of others, and therefore he was keen Our honorable Messenger to remind Muslims of death in all their times and conditions, on the authority of Abu Hurairah, may God be pleased with him, that the Prophet, may God’s prayers and peace be upon him, said: (Make mention of the destroyer of pleasures a great deal: death)Thus, writing a will is one of the means that reminds a Muslim of death. Especially for those who have debts, or for those who share with other people in material matters, and finally every Muslim must be keen to revive the Sunnah of our Prophet, the Prophet, through writing the will, and to start writing it from today.
